What taxes does a tourist property pay in Spain in 2026? Complete guide for owners
A tourist property in Spain does not have a single "tourist tax". Depending on how it is operated, it may be subject to IRPF or Corporate Tax, VAT, IBI, and possible local surcharges, in addition to informational obligations and regional or municipal taxes. Taxation changes if there is economic activity, if hotel services are provided, and, starting December 2026, due to the new VAT rule for certain stays of up to 30 nights.

1. IRPF: real estate income or economic activity
The Tax Agency explains that, generally, the income from tourist rentals is real estate income. It can be classified as economic activity when the legally established requirements are met.
AEAT also reminds that the reduction provided for certain rentals intended for habitual residence does not apply to tourist apartments, as they cover a temporary need.
2. Deductible expenses: tax benefit is not the same as revenue
Income is calculated by starting with revenue and subtracting the applicable deductible expenses. Therefore, two properties with €40,000 in revenue can have very different economic bases.
Gross income: €40,000
Tax-deductible expenses from the example: €14,000
Net income before other adjustments: €26,000
The example is educational: each expense must meet the applicable tax requirements.
3. VAT: 2026 has a particularly important date
The traditional information from AEAT distinguishes between tourist rentals without hotel industry services and accommodation with such services. However, the Royal Decree-Law 29/2026 introduces an additional modification effective from December 1, 2026 for certain rentals of furnished apartments or homes for up to 30 nights.
Therefore, for operations from December onwards, the owner should not rely solely on previous guides: they must check the current regulation and their specific case.
The informational pages of the Tax Agency consulted before the effective date of the reform may describe the previous regime. For an operation starting December 1, 2026, the updated legal reference is essential.
4. IBI and new surcharge for tourist accommodation
The ordinary IBI still depends on local regulations and the property. Additionally, the Royal Decree-Law 29/2026 allows certain municipalities to apply a specific surcharge to residential properties intended for tourist accommodation in municipalities located in areas of tense residential markets.
The maximums provided are 50%, 100%, or 150% depending on the number of tourist properties owned, but they do not apply automatically: municipal action is required.
5. Tourist taxes: there is no single national rule
Taxes on stays depend on the territory. An owner must always separate:
- state taxes on income or activity;
- VAT;
- property taxes;
- regional or local tourist taxes;
- other administrative obligations.
6. Does the platform pay your taxes for you?
This should not be assumed. An OTA may charge or collect certain amounts depending on the country and concept, but this does not eliminate the tax obligations of the owner. The amount received from Airbnb or Booking does not necessarily equate to the taxable or accounting income that must be declared without adjustments.
The financial question you should ask
More useful than asking "how much do I pay in taxes?" is to separate:
Income → commissions → operating expenses → result before taxes → taxes → final cash.
Taxation and profitability are not the same thing, but they should end up in the same account.
A property can be profitable before taxes and leave a much tighter cash flow afterward. Proper control requires calculating the operating result first and then applying the corresponding taxation to the individual, company, property, and territory.
